About the OHIM’s first ever IP Mediation Conference (Office for Harmonizatoin in the Internal Market), Alicante, Spain.

OHIM asked Fabienne van der Vleugel to anlayse the following topic : "Leave the Law outside the Door, Commercial Interests come first" (cf. conference 29.05.2014, website VDV AVOCATS).

WHO'S WHO LEGAL FRANCE 2014 : nomination.

For the third time, Fabienne van der Vleugel, as international commercial mediator, has been nominated in the WHO’S WHO LEGAL.

The 2014 April edition "Who’s Who Legal FRANCE 2014", in its article "Mediation Marketplace Analysis" (web site), and in its paper edition (page 68) analyses the development of mediation in France and has selected 11 recognized experienced mediators, including Fabienne van der Vleugel - together with her 10 other peers.

The civil procedure code contains modern provisions to facilitate the use of mediation and new legislation is expected to encourage the development of ADR in France. Mediation is an alternative dispute resolution method which is increasingly used by the managers of national or international companies.

Some companies even insureds in their sales general conditions or in some peculiar contract, mediation clauses in order to make sure that, in case of dispute, such dispute may be solved through a negotiated process between parties and, in case this direct negotiated process does not solved issue, practice may have recourse to mediation in order to void as much as possible the recourse of judicial proceedings.
